Terms & Conditions

1. General Information

The website referred to as 'Palsplay' or “the website”) is maintained by “VCARE MARKETING SERVICES”,a company registered with licencing authority, Dubai, United Arab Emirates (from here on referred to as ‘we’, ‘us’ or ‘our’).

For purpose of these terms & conditions, wherever the context so requires "you / your" or "user" or “customer” shall mean any natural or legal person who uses Palsplay.

By using Palsplay even if you Cancellation, Refund & Returns Policy are browsing and have not registered an account on Palsplay, you acknowledge that you consent and agree to and will abide by all terms, conditions and policies stated herein. These terms and conditions, policies and any other matter connected to ordering on Palsplay are governed by Dubai and UAE law.

Please revisit our terms & conditions regularly as they are subject to change without us directly informing you. Only the most recent version of our terms & conditions is accessible on Palsplay, and the most recent version supersedes all previous terms & conditions published by us.

2. General Information

You Agree and Confirm:

  1. You are not a minor under the age of 18 years. Minors under the age of 18 years are prohibited to register as a user, and/or to transact on Palsplay.

  2. You will provide true, accurate, complete, and current information in all instances where such information is requested of you. Palsplay reserves the right to independently verify and validate the information and other details provided by you at any point of time. If upon verification your details are found not to be true (wholly or partly), Palsplay has the right in its sole discretion (without any prior notice) to block your user account registration and debar you from using your Palsplay user account.

  3. You will not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

  4. You will not transmit any computer viruses or codes of a nature compromising security and privacy of Palsplay or its other user’s information/data.

  5. That you are using your best and prudent judgment before entering into any transaction through Palsplay and you are doing so at your sole risk.

  6. A breach or violation of any of the user conduct listed above entitles us to block your user account registration and debar you from using your Palsplay user account, without any prior notice.

3. Terms of Sale

By confirming that you wish to purchase any item on Palsplay, you are confirming that you agree with terms of sale listed herein:

  1. Prices shown on Palsplay include 5% VAT currently applicable as per UAE FTA regulations. Tax Invoices are sent to customers by email. 

  2. In event of any other government levies/taxes or any change in rate of VAT that may become applicable at the time of delivery, Palsplay reserves the right to change the prices accordingly and if customer needs to make any additional payment in connection to such new government levies/taxes, customer shall do so before delivery. Failure to do so by customer will lead to cancellation of order, and customer shall be eligible for refund as per SR # R1 of refunds table and refund timescale set out in Cancellation, Refund & Returns Policy.

  3. We cannot guarantee that every item displayed on Palsplay is in fact available at the stated price. We will make every effort to contact our customers if they have agreed to purchase a product and it is not available at the stated price. We will NOT charge you if you do not acknowledge that you agree to continue with the purchase at the revised price if it exceeds the price displayed when you agreed to the sale.

  4. We cannot guarantee that every item displayed on Palsplay is in stock and available for delivery. We will contact customers who have ordered products that are out of stock and customers will NOT be charged for these items.

  5. We make every effort to provide clear and accurate product details. Where the product is available in various colors or patterns, we cannot guarantee that your preferred color will be delivered unless the product color is stated in the product title. We are not liable for the accuracy or completeness of our product descriptions or the photographs of products and/or our featured product reviews. If you realize that the product does not match the stated description, photograph or reviews once receiving it, your sole remedy is to return it within 7 working days of receiving it in accordance with our Cancellation, Refund & Returns Policy.

  6. Customers agree to the terms of sale, subject to the stated price for all selected items, and complete their order for their selected items by pressing the ‘confirm’ button at the end of the checkout process.

  7. We will send all customers an acknowledgement email detailing the products that they have ordered. This is not an acceptance of the sale on the behalf of Palsplay.

  8. We will send all customers a dispatch confirmation email once their products have been shipped. This confirms that we have accepted to sell the selected items to you at the price specified at checkout unless we have subsequently notified you otherwise.

  9. We will notify you if we do not accept sale before we dispatch your items. Customers must notify us if they wish to cancel their order before items are dispatched. 

  10. We reserve the right to refuse a sale at our sole discretion, however, non-acceptance of the sale on behalf of Palsplay will usually take place for one or more of the following reasons: 

    1. The product(s) you ordered are out of stock. We will inform you of this by email. Your payment will be eligible for refund as per SR # R1 of refunds table and refund timescale set out in Cancellation, Refund & Returns Policy. We will inform you once they come back into stock, but you must place a new order if you wish to order the item(s) again.

    2. We are unable to authorize your payment. We will inform you of this by email. Your order will be canceled, and you must place your order again if you wish to purchase the item(s) by another method.

    3. We identify that the product you ordered was priced incorrectly or the description contained incorrect details. We will email you to inform this with the revised details and ask you whether you wish to proceed with the order. In case you decide to cancel the order, your payment will be eligible for refund as per SR # R1 of refunds table and refund timescale set out in Cancellation, Refund & Returns Policy.

    4. You have breached the User Conduct. We will inform you of this and your order will be cancelled and , your payment will be eligible for refund as per SR # R1 of refunds table and refund timescale set out in Cancellation, Refund & Returns Policy

4. Terms of Service

The following terms and conditions shall apply for products sold on Palsplay where we undertake the installation/ commissioning (Hereinafter also referred to as “work” or “works”) along with sale of any product:

  1. In the absence of detailed agreements, the installation/commissioning shall involve the parts/components set out in the order confirmation or the parts/components those are provided by manufacturer along with product. Any additional parts/components required for otherwise, either in general or especially due to site conditions will be customer’s responsibility to provide. In case our installation team sources any such part/component, customer will pay the cost at actuals.

  2. Additional work undertaken by us (installation preparation, production of plans and / or instruction manuals, installation supervision work, etc.) shall be made only based on separate agreements and quotes.

  3. The technical assistance of the customer must ensure that our personnel can start work immediate after their arrival and be continued without delays until the acceptance procedure by the customer. In particular the access routes and the workplace or installation site must be level at floor height, any foundations and other masonry required for the installation must have been completed as shown on the drawings or descriptions supplied by us (if this has been agreed with us), they must be dry and hardened and the base walls must be built and backfilled, the wall and ceiling plastering work must have been completed, doors and windows installed and any wall openings specified by us must have been opened.

  4. For any work which requires such preparations mentioned in point “c” above to be made by the customer (Pre-requisites), the customer shall receive a written or telephone inquiry from us in good time beforehand as to whether the Pre-requisites have been completed in full by the customer.

  5. In the event of the non-fulfilment or inadequate fulfilment of Pre-requisites, and/or in circumstances that lead to a delay or break in our work because of such non-fulfilment or inadequate fulfilment of Pre-requisites, and/or in the event of the customer being in default with payments, we expressly reserve the right to withdraw from our obligation to perform the work and to recall our personnel. Any additional costs incurred because of such action shall be borne by the customer.

  6. The customer must provide support for our personnel at its own expense when they are completing our work. The customer shall be obliged to provide technical assistance, to:

  1. provide the necessary utility items such as heating, lighting, water, and the required connections.

  2. provide suitable heating, lighting, washing facilities, sanitary facilities, and First Aid facilities for our personnel.

  1. Installation/commissioning work is in-separable part of our pricing. Hence in case customer decides to undertake the installation/commissioning work at his/her own, customer is not entitled to claim any refund relating to Installation/commissioning work not done by us.

  2. In event if customer decides to return the order due to any delay in commencement of  installation/commissioning within the time frame promised by us, customer shall be entitled for refund as per SR # R1 of refunds table and refund timescale set out in Cancellation, Refund & Returns Policy

  3. In event customer finds product not suitable at the time of installation/commissioning, customer shall be entitled for refund after deduction shipping cost as well as costs incurred by us for arranging installation/commissioning work. We will reasonably arrive at such cost at its sole discretion without any obligation to provide any supporting bills/proofs to customer of such costs incurred.

5. Terms of Deliver

  1. We are not liable for any delays to our stated delivery times.

  2. We cannot guarantee an assigned delivery time for your items. If you are not at home when we deliver your order, we will try again at a different time of day. After three failed attempts of delivery, you will need to contact assigned courier company and arrange collection from them from any of their depots in UAE at your own cost.

  3. Customers have a right to return products they have not used within 7 working days of receiving them, providing items have incurred no wear or damage since being delivered to the customer and products are returned in their original packaging. If we are satisfied with the condition of returned items, we will issue customers with a replacement or store credit for the value of the item(s). In some cases, we can also issue refunds to customers. Please see our Cancellation, Refund & Returns Policy for more details.

    Shipping To return your product, you should mail your product to: Al Khoory Al qusais Dubai United Arab Emirates You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. Depending on where you live, the time it may take for your exchanged product to reach you, may vary. If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
